Insight into energy and infrastructure – winter 2021 – issue 5 | Shearman & Sterling LLP

We are pleased to present you the fifth edition of our Energy & Infrastructure Insight with expert information and analyzes on current topics in the energy and infrastructure industry around the world.

The energy transition is a key global issue that has met with widespread interest. In this latest edition we present a roadmap of the most important European regulatory developments relevant to hydrogen in 2021. Hydrogen has clearly become a central part of the European Commission’s decarbonization agenda.

Emission certificates offer a credible way of reducing the carbon footprint of various sectors and meeting emission reduction targets. We are studying how carbon credits are issued for sale and we are reviewing the various climate protection projects available for loan buyers.

On July 14, 2021, the European Commission published its proposal for a Carbon Border Adjustment Mechanism (CBAM), which will be introduced gradually from 2023 and will be fully operational in 2026. We describe how CBAM certificates work and how they serve to reduce carbon leakage and for which sectors they apply. We also provide insight into the expected opportunities for appeals against CBAM-related decisions.
